Terms of Service

Rally for Serve is the storefront brand. The seller and storefront operator is Rally for Serve Sports LLC. Shopify provides ecommerce and checkout infrastructure; Shopify is not the seller under these terms.

By using this shop, and by submitting an order when purchasing is available, you agree to these terms and the policies linked from them. If you do not agree, do not use the shop or submit an order.

You must be legally able to enter into a binding contract in your jurisdiction. If you use the shop for an organization, you represent that you have authority to bind it.

Product availability, quantities, specifications, and prices may change. A product is available to purchase only when the shop displays an active purchase control for an available Shopify product.

Products identified as In Development, Exploring Concept, or otherwise presented through Drop Lab are developmental and are not offers for sale unless the shop expressly provides an active purchase or preorder option under separate terms. Designs, materials, specifications, names, timing, pricing, and availability may change, and a concept may never enter production.

We work to display colors and details accurately, but screens vary and small differences in color, texture, placement, packaging, and other non-material details may occur. Product descriptions and photographs do not override rights that cannot be excluded under applicable consumer law.

Follow product labels, care instructions, warnings, and intended-use guidance. Sporting goods perform differently depending on conditions, storage, wear, and individual use. Product descriptions do not promise a particular competitive result or eliminate the ordinary risks of sport.

Prices displayed by the shop are provided through Shopify and may change before an order is accepted. Applicable shipping charges and taxes are shown during checkout. If information, availability, or pricing is materially incorrect, the seller may correct the error or cancel the affected order where permitted by law. Any amount collected for a cancelled order will be returned through the original payment method.

Submitting an order is an offer to purchase. An automated acknowledgement does not by itself mean the order has been accepted. Acceptance occurs when the seller confirms the order for fulfillment or ships it, subject to any mandatory rule that applies in your jurisdiction.

Where legally permissible, an order may be refused or cancelled because of suspected fraud, unauthorized payment, inventory or shipping constraints, purchase limits, or a material listing error. These rights do not limit mandatory consumer protections.

Checkout is hosted by Shopify. Payment credentials are submitted to the applicable checkout and payment providers, not entered into the Rally storefront application. Payment authorization may occur before order acceptance. Shopify and payment providers may apply their own platform or payment terms, but they do not replace these sale terms or make Shopify the seller.

Shipping estimates, available methods, and charges are presented at checkout when available. Shipping, return, exchange, and refund rules are governed by the Shipping & Returns Policy, which forms part of these terms. Nothing in that policy limits rights that cannot be waived under applicable law.

Rally for Serve™, R4S™, related logos, product artwork, photographs, copy, and site content are owned by or licensed to Rally for Serve Sports LLC and its affiliated entities or licensors. You may use the shop for personal, non-commercial purposes only and may not reproduce or commercially exploit protected content without permission.

You may not misuse the shop, interfere with its operation or security, introduce malicious code, scrape it in a manner that burdens the service, impersonate another person, submit fraudulent information, violate another person’s rights, or use the shop for unlawful activity.

If you send product feedback, concept input, reviews, photographs, or other material, you represent that you have the right to submit it. Unless separate terms are presented, submitting feedback does not transfer ownership of your original work, but gives Rally for Serve Sports LLC permission to use that feedback to evaluate, develop, improve, and market products and the shop. Do not submit confidential or proprietary ideas through general feedback or support channels.

To the extent permitted by law, the shop is provided on an “as available” basis without warranties beyond those expressly stated or required by law. The seller does not guarantee uninterrupted or error-free access.

To the extent permitted by law, the seller and its service providers will not be liable for indirect, incidental, special, or consequential loss arising from use of the shop. Nothing in these terms excludes liability or remedies that cannot be excluded or limited under applicable law.

Where permitted by law, you are responsible for losses reasonably arising from your unlawful misuse of the shop, your violation of these terms, or your violation of another person’s rights. This section does not apply where prohibited by consumer law.

These Terms and any dispute arising from or relating to the shop or a purchase from Rally for Serve Sports LLC are governed by the laws of the State of Colorado, without regard to conflict-of-law principles.

To the extent permitted by applicable law, any legal proceeding arising from or relating to these Terms or a purchase through the shop will be brought in the state or federal courts serving El Paso County, Colorado.

Nothing in this section limits any mandatory consumer rights or protections that apply based on a customer’s location and cannot legally be waived.

If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law. These terms may be updated prospectively. The version presented when an order is submitted applies to that order unless applicable law requires otherwise.
